Virginia Child Custody Attorney

In Virginia, child custody is often the most disputed area in divorce negotiations as they affect both emotional and financial aspects.  The Court determines custody based on what it believes to be in the best interest of the child/children. 

 

Sole Custody

 

Sole custody means that one of the parents has the authority to make legal decisions for the child/children.  In these situations, the parent that is not awarded sole custody can be awarded specific visitation with the child/children.

 

Joint Custody

 

In joint custody, both parents are awarded legal custody of the child/children, with one of the parents designated as the primary residential parent.  In this case, both parents maintain the ability to make major decisions for their child/children.  Such major decisions include the official residence of the child, medical treatment, education, child care, etc.

 

Shared Custody

 

With Shared Custody, both parents share legal custody with each parent maintaining specific periods of responsibility with the child/children.  In this situation, both parents have the right to make major decisions on an equal basis for their children.  In each of these cases, amendments and additional considerations can be made at a later, agreed-upon time.

 

Custody Litigation
