Uncontested Divorce
Uncontested divorce actions are those in which the parties have agreed upon all of the marital issues, how to divide your assets and debts, who gets custody and pays child support, and whether one spouse needs to pay spousal support to the other.
Uncontested divorces can also include those situations where it is anticipated that only one side will actively participate. “No-fault divorce” suits are those in which the parties only ask for a divorce on the grounds that they have lived separate and apart for the period of time required by law.
Contested Divorce
In the situation where the marital parties cannot agree on the division of the assets, debts, child custody decisions, etc., a contested divorce must be pursued.

Contested vs. Uncontested Divorce
When we begin this process together, we will start by determining the general type of divorce. In Virginia, there are two types, Contested and Uncontested.
